1. General Provisions
1.1 This website is operated by PrettyShopia. Terms such as “we,” “us,” and “our” refer to PrettyShopia as used in these Terms and Conditions.
1.2 By purchasing a product from our online shop, you agree to the Terms and Conditions outlined in this document. These Terms apply to all orders you place with us.
1.3 These Terms also include the provisions from our Privacy Policy and our Refund Policy.
2. Online Shopping
2.1 We make every effort to ensure that the details provided for each item are correct at the time of entry into the system.
2.2 Although we strive to depict colors, textures, and surfaces as accurately as possible, variations may occur due to different monitor or device displays. Therefore, images may not always reflect the actual products or services.
2.3 We may not accept your order for one or more of the following reasons:
i) The item ordered is out of stock.
ii) We are unable to authorize your payment or have legitimate reasons to suspect that your payment is fraudulent.
iii) There was an error in the pricing or product description.
iv) There is a system or procurement error.
v) You have not passed our customer validation checks.
2.4 After placing an order, you will receive an email with the order details. This email does not confirm that your order has been accepted.
2.5 Your order is only considered accepted once the goods have been shipped.
3. Right of Withdrawal
3.1 You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day you or a third party designated by you takes possession of the goods.
3.2 To exercise your right of withdrawal, you must inform us by email at support@prettyshopia.com of your decision to withdraw from the contract by an unequivocal statement.
3.3 Exceptions to the Right of Withdrawal: The right of withdrawal does not apply to sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery.
3.4 Consequences of Withdrawal: If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day we received your withdrawal notice.
3.5 You bear the direct costs of returning the goods.
4. Payment
4.1 PrettyShopia is a small business in accordance with § 19 UStG (German VAT Act), so no VAT is charged or displayed on invoices.
4.2 Payments are securely processed through payment providers such as PayPal, credit card (Visa, MasterCard), bank transfer, and Square. You can choose your preferred payment method during checkout.
4.3 After confirming an order, we receive a payment notification. In case of payment delays, your order may be temporarily “held” until payment is confirmed. We will inform you in such cases.
5. Warranty
5.1 Statutory warranty rights apply. In case of defects in the goods, you are entitled to demand rectification (repair or replacement delivery), reduction of the purchase price, or cancellation of the contract in accordance with § 434 et seq. BGB (German Civil Code).
6. Delivery
6.1 After completing your purchase, delivery options will be displayed. Delivery times are estimates and may vary due to circumstances beyond our control (e.g., courier delays or peak seasons). For more information, please refer to our “Delivery & Packaging” page.
6.2 If the shipping address was entered incorrectly and your order is returned to us, additional shipping costs (these shipping costs vary per item and will be automatically calculated and refunded by us) will apply. If the re-delivery fee is not paid, your order will be refunded minus the original shipping costs.
6.3 If your order arrives damaged, please report it within 7 days of receipt. Ensure that you attach photos of the damage when contacting us for a replacement or refund.
6.4 For international orders, additional shipping fees may apply. Estimated delivery times for international shipments may vary and will be displayed during the checkout process.
7. Data Protection
7.1 Further information on the processing of your personal data can be found in our Privacy Policy, which you can view on our website.
8. Limitation of Liability
8.1 PrettyShopia is not liable for indirect or consequential damages resulting from the use of the products.
8.2 We are not liable for delays or failures to perform our obligations caused by circumstances beyond our reasonable control (e.g., natural disasters, pandemics, government measures).
9. Jurisdiction
9.1 For all disputes relating to this agreement, German law applies.
9.2 If the customer is a consumer, the statutory jurisdiction applies. Otherwise, the court at the location of PrettyShopia is responsible.
10. Changes to the Terms and Conditions
10.1 PrettyShopia reserves the right to modify these Terms and Conditions at any time without prior notice. The changes will take effect from the time of their publication on the website.
10.2 If any part of these Terms is found to be invalid, the remaining provisions shall remain in full force.
11. Monthly Giveaway (Email Sign-Up)
11.1 A winner will be randomly selected from all email sign-ups each month and announced within two weeks.
11.2 The winner will receive a voucher worth 20€ for purchases over 50€, valid for six months from the date of notification.
11.3 By participating in the giveaway, you agree to our Privacy Policy regarding the use of your email data.
